Open Question: Can you get out of a lease early?

Published on January 14, 2010 by Technology Slice

We live in an apartment complex and our lease isn’t up till May 30th. However, my fiance may be offered a job and might have to take it in March lets say. Is there anything we could do, or will we have to pay two rents and just pretend we are living here? Maybe if the job really wants him they’d be willing to pay the last two months rent, it would only be 1400 lol. I mean I guess he could commute everyday but that’s like an hour and 15 mins away, both ways that 2 1/2 hours! blah! what a lot of gas!

Open Question: Broke lease– help me get my deposit back!!?

Published on January 9, 2010 by Technology Slice

So I had to break my one year lease six months early (A LOT– I know) but my job was transferred (and it wasn’t driving distance) and it is a good paying job so with this economy I couldn’t just not accept the transfer…

PLUS– I know the law (at least somewhat) and it states that if you break your lease and at any point in the remaining months you have on your lease someone rents the unit.. they can only charge you for when it was vacant.. they also have to make good faith efforts (as well as I) to rerent it…

well the manager at the apartment offered me a deal.. she said they would not send me to collections for the remaining amount left on my lease but they would keep my FULL security deposit..

I told them I did not want to take it because I have a coworker who still lives near my old apartment who is willing to rent my apartment out next month (when her lease is up)

My rent is $975… so technically assuming she still rents out my unit– I would only owe one month… so them keeping my security deposit (of $2350) would be foolish..

well it has been two weeks since I have moved out and I have tried to call and email the manager many times… and have heard nothing…

Is there any way she can keep my full security deposit even if I tell her to send me to collections (it is in a HIGH DEMAND area so I know that it will be rented out no matter what very soon)
